Kevin Roper, the driver of the Walmart truck that crashed into a limo that killed one man and seriously injured Tracy Morgan, will ask the judge to throw out the criminal charges against him. Roper's attorney, David Glassman, made the revelation to The Associated Press, and he added that the truck driver hadn't been indicted on one count of death by auto and four counts of assault by auto.
Glassman claims that Roper is unable to get a fair trial due to the negative publicity surrounding him since the June 2014 crash. He added, "Civil cases are routinely stayed for criminal cases to proceed. Had that occurred and a stay issued in the civil case, a tsunami of negative pretrial publicity would have been avoided and Roper's right to a fair trial would have been preserved."
