An Oklahoma woman who married her daughter in March 2016 has pleaded guilty to incest. The woman also married one of her sons in 2008.
46-year-old Patricia Spann, from the town of Duncan, about 80 miles southwest of Oklahoma City, pleaded guilty Tuesday to receive a two-year prison sentence.
Her daughter, 26-year-old Misty Spann, pleaded guilty in November and received probation. Her plea, however, was later withdrawn after it was discovered that the deferred sentence probation she received was not allowed under Oklahoma law.
Under state law, marrying an immediate relative is considered incest regardless of whether any sexual interaction took place.
According to a police affidavit, Patricia Spann said that she thought the marriage was legal because she lost custody of her two sons and daughter years ago and doesn't appear on their birth certificate, adding that she wasn't reunited with her daughter until two years ago.
Court records show that Misty Spann had the marriage annulled in October due to "fraud and illegality," reported the New York Post.
During the investigation, detectives learned that the elder Spann also married one of her sons in 2008; according to a police affidavit, he filed for an annulment 15 months later because of "incest," stating that he was married to his birth mother.
