According to reports, the Buffalo police officers seen shoving an elderly man to the ground during last summer's wave of protests against police brutality in the wake of the killings of George Floyd and Breonna Taylor. 

A grand jury in Western New York dismissed the felony charges against officers Robert McCabe and Aaron Torgalski who shoved 75-year-old Martin Gugino to the ground causing him to bleed from his head. 

During a press conference on Thursday,  Erie County District Attorney John Flynn defended his decision to bring felony charges against the officers. “I apologize for nothing,” said Flynn. He explained how the video footage showed the officers committed a crime but added that Gugino should've been arrested for breaking curfew despite acknowledging he “should not have been shoved."
