The capital murder trial for rapper Tay-K began on Tuesday (April 1) in San Antonio, following years of delays.

During the first day of proceedings, four witnesses took the stand, including two individuals who claimed to have witnessed the altercation involving Tay-K and photographer Mark Anthony Saldivar, who was shot and killed in 2017.

One witness, Paul Caballero, testified that he saw a struggle inside a car behind him, stating, “The passenger of that vehicle was fighting with someone in the back.” He recalled seeing Saldivar jump onto the hood of the car, screaming for help. Caballero later saw a person lying in the drive-thru of a nearby Chick-fil-A, whom another witness, Ernest Reyes, identified as Saldivar.

Prosecutors allege that Tay-K had invited Saldivar to a photoshoot and, at some point, demanded the photographer hand over his backpack containing his camera equipment.

On the second day of the trial, the prosecution called Anna Delgado to testify. Delgado also witnessed the altercation and described seeing Saldivar clinging to the hood of a moving car that then sped into a Chick-fil-A parking lot.

"Everything happened so fast," Delgado recalled. “The victim stood up and stomped his foot on the windshield... That’s when the gentleman from the front passenger side stepped out… He just shoots him, and I see him fall.”

Despite their testimonies, none of the witnesses identified Tay-K as the shooter.

Tay-K is already serving a 55-year sentence for the 2016 murder of Ethan Walker, 21, during a home invasion in Fort Worth. If convicted in this case, he faces the possibility of life in prison.
